iDeeJay Terms of Service

1. Acceptance of Terms
These Terms of Service (“Terms”) are a legally binding agreement between you and iDeeJay (“iDeeJay,” “we,” “us,” or “our”) governing your access to and use of the iDeeJay mobile application, website, web session experiences, and related services (collectively, the “Service”).
By creating an account, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility and Age Requirements
You must be at least 13 years old to create or use an iDeeJay account. If you are under the age of legal majority where you live, you may use the Service only with permission from a parent or legal guardian.
Some events, venues, or features promoted or discovered through iDeeJay may have separate age restrictions, including 18+ or 21+ requirements. You are responsible for complying with venue rules, local law, identification requirements, and any age restriction applicable to an event.
3. Accounts and Account Security
You are responsible for providing accurate account information, maintaining the confidentiality of your credentials, and all activity that occurs through your account.
You may not impersonate another person, create an account for someone without authorization, sell or transfer your account, or use another person’s account without permission.
Notify support@ideejay.app if you believe your account has been compromised.
4. The iDeeJay Service
iDeeJay is a social music and live-event platform that may allow listeners, DJs, venues, promoters, event planners, and other users to discover or host sessions, request and vote on music, react to what is playing, communicate, follow profiles, create or share content, promote events, manage professional profiles, receive booking inquiries, and use other music or event-related features.
Features may vary by account type, location, device, subscription status, music-service eligibility, and product availability. We may add, modify, suspend, test, or discontinue features at any time.
5. Live Sessions, Requests, Voting, and Host Control
Song requests, votes, reactions, boosts, and similar crowd signals are suggestions and participation tools. They do not guarantee that a requested song will be played.
The DJ, host, venue, or authorized session operator retains final control over playback, queue order, moderation, session access, and whether to accept, reject, skip, reorder, or remove a request.
You may not artificially manipulate votes, reactions, requests, rankings, session metrics, or other engagement signals through bots, multiple accounts, scripts, coordinated abuse, or other deceptive methods.
6. Music Services and Playback
iDeeJay may integrate with Apple Music, Spotify, and other supported music services. iDeeJay does not grant you a subscription to those services, and access to particular tracks, playback features, libraries, search, authentication, or request functionality may depend on your account with the applicable provider and the features iDeeJay makes available for that provider.
Features may differ by music service. A supported service may, for example, allow search, authentication, or song-request functionality without allowing playback through iDeeJay.
Music availability may differ by country, subscription, licensing territory, catalog changes, or provider restrictions. Third-party music services are governed by their own terms and privacy policies.
Unless expressly stated otherwise, iDeeJay does not sell or license recorded music to you and does not guarantee that any particular song, artist, album, playlist, or stream will remain available.
7. DJs, Venues, Promoters, and Event Planners
Professional accounts and profiles may be used by DJs, venues, promoters, event planners, and other event professionals. You are responsible for the accuracy of the information you publish, including availability, pricing, event details, residencies, social links, credentials, and promotional claims.
iDeeJay does not employ, manage, represent, endorse, or guarantee any DJ, venue, promoter, planner, host, attendee, or other user merely because they appear on the Service.
Unless we expressly agree otherwise in writing, iDeeJay is not a party to agreements between users for performances, bookings, events, venue services, or other offline services.
8. Bookings and Offline Events
Where booking or inquiry tools are available, iDeeJay may facilitate introductions and communications between users. The parties are responsible for negotiating and performing any resulting agreement, including pricing, deposits, cancellations, insurance, taxes, permits, security, equipment, and performance obligations.
Attending or organizing live events involves risks outside iDeeJay’s control. You are responsible for your own safety and for evaluating venues, users, event details, travel, transportation, and local conditions before participating.
iDeeJay is not responsible for event cancellation, venue admission decisions, conduct at an event, personal injury, property loss, or disputes between users except to the extent liability cannot legally be excluded.
9. Third-Party Events, Ticketing, and External Services
iDeeJay may display event, venue, attraction, ticketing, or other information obtained from third-party services, including Ticketmaster and other event-data providers. Third-party event information may be incomplete, delayed, changed, canceled, or unavailable, and iDeeJay does not guarantee its accuracy.
When you select a link or button that opens a third-party ticketing, venue, artist, map, music, or other service, you are leaving iDeeJay or interacting with a service that we do not control. Your use of that service, including any purchase, refund, admission, account, or data practices, is governed by the third party’s terms and privacy policy.
Unless expressly stated otherwise, iDeeJay is not the ticket seller, merchant of record, event organizer, or venue for third-party events displayed through the Service.
10. Music and Public Performance Rights
DJs, venues, promoters, event organizers, and other users are responsible for obtaining any licenses, permissions, public-performance rights, synchronization rights, venue permissions, or other authorizations required for their activities.
iDeeJay’s technology does not replace music licensing obligations that may apply to a venue, DJ, promoter, broadcaster, or event organizer.
11. User-Generated Content
The Service may allow you to post or submit profile information, photos, comments, messages, reactions, session names, song requests, event information, reviews, Moments or posts, and other materials (“User Content”). You retain ownership of your User Content.
By submitting User Content, you grant iDeeJay a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, distribute, adapt, and otherwise use that content as reasonably necessary to operate, secure, moderate, promote, and improve the Service. This license ends when the applicable User Content is deleted from our active systems, including through account deletion, subject to reasonable technical backup periods and information we are legally required to retain.
You represent that you have the rights necessary to submit your User Content and that doing so does not violate law or another person’s intellectual-property, privacy, publicity, contractual, or other rights.
12. Community Safety, Reporting, and Blocking
iDeeJay may provide tools to report content, accounts, messages, sessions, events, or behavior and to block other users. Blocking may limit or prevent interactions and visibility between accounts across supported parts of the Service.
We may review reports, remove content, restrict features, suspend accounts, preserve relevant information, or take other action when we reasonably believe these Terms, our safety rules, third-party rights, or applicable law may have been violated.
Reporting or blocking tools are not emergency services. If you believe you or someone else is in immediate danger, contact local emergency services or appropriate authorities.
13. Prohibited Conduct
You agree not to misuse the Service. Prohibited conduct includes:
Harassing, threatening, bullying, stalking, exploiting, or abusing another person; posting unlawful, hateful, sexually exploitative, fraudulent, defamatory, or infringing content; impersonating another person, business, DJ, venue, promoter, or iDeeJay representative; using iDeeJay to facilitate violence, trafficking, illegal drug sales, fraud, or other unlawful activity.
Attempting to bypass blocks, suspensions, access controls, location restrictions, payment controls, or moderation systems; scraping, crawling, harvesting, or extracting data except as expressly permitted; using bots, scripts, emulators, automation, or coordinated accounts to manipulate the Service.
Reverse engineering, decompiling, probing, disrupting, overloading, or attempting unauthorized access to the Service; uploading malware or malicious code; or using the Service in a manner that violates applicable third-party terms, including music-service terms.
14. Paid Features, Subscriptions, Boosts, and Virtual Items
iDeeJay may offer paid subscriptions, premium account features, boosts, tokens, credits, promotional placements, or other digital items (collectively, “Paid Features”). Availability and pricing may change.
Purchases made through Apple’s App Store are billed by Apple and are subject to Apple’s payment, subscription, cancellation, and refund rules. Where another authorized payment method is offered, the applicable checkout terms will be shown at purchase.
Unless required by law or expressly stated otherwise, virtual items have no cash value, are not legal tender, are not transferable outside permitted Service functionality, and cannot be redeemed for cash.
15. Tips and Creator or DJ Earnings
Where tipping or earnings features are available, users may be able to support eligible DJs or other recipients. Eligibility, platform fees, payment processing, payout timing, minimums, verification, taxes, refunds, chargebacks, and other rules may be described in the applicable product flow or supplemental terms.
Recipients are responsible for determining and paying taxes associated with amounts they receive. iDeeJay may withhold, delay, reverse, or refuse a transaction when reasonably necessary for fraud prevention, legal compliance, payment disputes, sanctions screening, or platform integrity.
A tip is voluntary and does not create an employment, agency, partnership, fiduciary, or performance relationship with iDeeJay.
16. Advertising and Promotions
The Service may display advertising, sponsored content, venue promotions, artist promotions, or other paid placements. Sponsored or paid placements may be labeled where required.
Advertisers and sponsors are responsible for the accuracy and legality of their offers. iDeeJay does not guarantee a promoted product, event, artist, venue, or service.
17. Intellectual Property and iDeeJay Rights
The Service, including its software, source code, design, interfaces, branding, graphics, logos, trademarks, and non-user content, is owned by or licensed to iDeeJay and is protected by intellectual-property laws.
Subject to these Terms, iDeeJay grants you a limited, personal, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose. No ownership rights are transferred to you.
18. Copyright Complaints
If you believe content on iDeeJay infringes your copyright, send a notice to dmca@ideejay.app identifying the copyrighted work, the allegedly infringing material, where it appears, your contact information, a good-faith statement, a statement of accuracy and authority made under penalty of perjury where required, and your physical or electronic signature.
We may remove or restrict allegedly infringing material and may terminate repeat infringers when appropriate.
19. Location and Event Discovery
Certain features may use device location or a location you provide to help you discover nearby sessions, events, venues, DJs, or other relevant content. Location-based results are approximate and may be incomplete, delayed, inaccurate, unavailable, or affected by device settings, third-party map services, or third-party event-discovery services.
Do not rely on iDeeJay as a navigation, emergency, safety, or real-time crowd-management service.
20. Beta, Availability, and Service Changes
Some iDeeJay features may be offered as beta, preview, experimental, limited-release, or test functionality. Such features may change, fail, be unavailable, or contain errors.
We do not guarantee uninterrupted access, permanent storage of content, compatibility with every device or third-party service, or continued availability of any feature.
21. Termination and Account Deletion
You may stop using the Service at any time. All users can initiate deletion of their iDeeJay account from within the iDeeJay app, and you may contact support@ideejay.app for assistance. Account deletion is handled as described in our Privacy Policy and applicable law.
We may suspend, restrict, or terminate access when we reasonably believe you violated these Terms, created risk or legal exposure, engaged in fraud or abuse, failed to pay amounts due, or when required to protect users, iDeeJay, or third parties.
Sections that by their nature should survive termination—including intellectual-property provisions, payment obligations, disclaimers, limitations of liability, indemnification, and dispute provisions—will survive.
22. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” iDEEJAY DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
iDeeJay does not guarantee the conduct, identity, availability, reliability, quality, safety, legality, or suitability of any user, DJ, venue, promoter, planner, event, booking, music selection, or third-party service.
23. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, iDEEJAY AND ITS OWNERS, AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY ARISING FROM OR RELATED TO THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, iDEEJAY’S TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO iDEEJAY FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) $100 USD.
Some jurisdictions do not allow certain warranty exclusions or liability limitations, so some of the above may not apply to you.
24. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless iDeeJay and its owners, affiliates, officers, employees, contractors, and agents from third-party claims, liabilities, damages, losses, and reasonable expenses arising from your User Content, your use or misuse of the Service, your offline activities or events, your violation of these Terms, or your violation of another person’s rights.
25. Dispute Resolution and Arbitration
Before filing a formal claim, you and iDeeJay agree to attempt in good faith to resolve the dispute informally for at least 30 days after written notice is sent to legal@ideejay.app.
Except for disputes that qualify for small-claims court or claims for injunctive or equitable relief relating to intellectual property, unauthorized access, or misuse of the Service, and except where prohibited by law, disputes that cannot be resolved informally will be resolved by individual binding arbitration administered by the American Arbitration Association under its applicable Consumer Arbitration Rules.
YOU AND iDEEJAY WAIVE, TO THE EXTENT PERMITTED BY LAW, THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION.
You may opt out of this arbitration agreement by emailing legal@ideejay.app within 30 days after you first accept these Terms and clearly stating that you are opting out of arbitration, together with the email address or username associated with your account.
Nothing in this section limits rights or remedies that cannot legally be waived under the law that applies to you.
26. Governing Law
Except where mandatory law provides otherwise, these Terms and disputes arising from them are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
For disputes that are not subject to arbitration, you and iDeeJay consent to the exclusive jurisdiction of the state and federal courts located in Harris County, Texas, unless applicable consumer law gives you the right to bring a claim elsewhere.
27. Apple App Store Terms
If you downloaded iDeeJay from Apple’s App Store, these Terms are between you and iDeeJay, not Apple. Apple is not responsible for the Service or for providing maintenance or support except as required by applicable App Store terms.
You must comply with applicable third-party terms when using the Service. Apple and its subsidiaries may be third-party beneficiaries of applicable provisions relating to your use of the iOS application to the extent required by Apple’s terms.
28. Changes to These Terms
We may update these Terms as the Service evolves or as legal requirements change. When changes are material, we may provide notice in the app, by email, through the website, or by another reasonable method before or when the revised Terms take effect.
Your continued use of the Service after updated Terms become effective constitutes acceptance where permitted by law. If you do not agree to an update, you must stop using the Service.
